The permitting authority for the City of Minden, the Kearney County seat in south central Nebraska and the home of the Harold Warp Pioneer Village. Minden issues its own building permits: applications go to City Hall on North Colorado Street, the City Building Inspector reviews them, issues or denies them and reports every permit issued to the city council each month. The City has adopted the 2018 International Residential Code and the 2018 International Building Code, striking one section from each, and both strikes are fire-sprinkler or fire-suppression sections rather than anything on a roof. What a roofer should read carefully here is the adopting section itself, which names an edition and then adds an open-ended alternative, and the amendment section, which still carries language written for the Uniform Building Code that Minden replaced in 2010.

  • state_level: STATEWIDE AND UNAVOIDABLE. Neb. Rev. Stat. 48-2104(1), in the Contractor Registration Act, provides that "Before performing any construction work in Nebraska, a contractor shall be registered with the department." The department is the Nebraska Department of Labor. A roofer sits well inside the statutory definitions rather than at their edge. "Construction" means "work on real property and annexations, including new work, additions, alterations, reconstruction, installations, and repairs" under 48-2103(2), and "Contractor" means a person or firm "engaged in the business of the construction, alteration, repairing, dismantling, or demolition of buildings ... and every other type of structure" under 48-2103(3). There are two exemptions and both are in 48-2104(1) - work on one's own property, and "any person who earns less than five thousand dollars annually for construction services." Registration is with the State and is what the boolean on this record turns on.

Chapter 14, Article III of the Code, the City's building-code article, was read in full for this record and it sets up no registration, licensing or bonding scheme for roofers or for general building contractors. The one trade the chapter licenses is plumbing, and it says so where a roofer would not think to look - section 14-1, the chapter penalty section, ends "If any licensed plumber or any of his employees shall violate any of the provisions of this article, such violation shall be sufficient cause for revocation of his license", and Article V of the same chapter carries the plumbing code. This is a statement about what the City's building chapter contains, not a statement by the City that a roofer needs nothing local, and other chapters of the Code carry business and occupation provisions a contractor may still fall under. Permit process note
Minden takes building permit applications at City Hall, 325 North Colorado Street, PO Box 239, Minden, Nebraska 68959, on 308-832-1820 or [email protected], and offers both a printed form and an online portal submission. The review path is set out in section 14-52 of the Code: the application goes to the mayor and council on a form furnished by the city clerk, "the building permit application will be reviewed by the city building inspector and any other department of the city to whom the building inspector refers said application", and if the inspector finds it meets all city requirements the inspector issues the permit. Where it does not, the inspector may deny it or refer it to the board of adjustments for a variance, and may refer it to any other commission or department. The same section requires the inspector to report all permits issued to the city council at least monthly, so a Minden permit is a matter of public record on the council agenda. Section 14-53 makes the building inspector the enforcement officer for the adopted codes, and section 14-57 gives a right of appeal to the city council within thirty days where the inspector refuses a permit or where it is claimed the code has been misconstrued. Minden adopts its building codes at section 14-51 of the Code of the City of Minden, in Chapter 14, Buildings and Building Regulations, Article III. The section provides that the mayor and city council adopt, "for the purpose of prescribing regulations governing the erection, construction, enlargement, altercation, repair, moving, removal, conversion, demolition, occupancy, equipment, use, height, area and maintenance of buildings or structures in the city, that certain codes known as the International Building Code (striking sec. 903) and the International Residential Code for One- and Two-Family Dwellings, published by the International Code Council, being the 2018 edition (striking sec. R313) or the most current edition on file in the office of the city clerk." So the residential code for a Minden house is the 2018 International Residential Code with its fire-sprinkler section R313 taken out, and the commercial code is the 2018 International Building Code with its automatic fire-suppression section 903 taken out. Neither strike touches a roof. TWO POINTS OF IMPRECISION IN THE CITY'S OWN TEXT THAT A ROOFER SHOULD KNOW BEFORE QUOTING A SECTION NUMBER, BOTH REPORTED HERE WITHOUT BEING RESOLVED. First, the adopting section names the 2018 edition and then adds "or the most current edition on file in the office of the city clerk", so the text names a dated edition and an open-ended alternative in the same sentence, and the clerk's shelf rather than the ordinance decides which applies. The codified adopting trail runs Ord. No. 1156 of 5-17-10, Ord. No. 1203 of 8-20-15, Ord. No. 1227 of 9-18-17, Ord. No. 1254 of 5-17-21 and Ord. No. 1292 of 6-17-24, so the section has been revisited as recently as 2024. Second, the surrounding sections still speak of the previous code. Section 14-52 opens "Any person desiring a permit required in the Uniform Building Code", and section 14-56, the amendment section, reads in full: "The code adopted in this article is amended and changed in the following respects: Part IV is deleted. Section 304 is amended to provide that building permit fees shall be in the amount as shall from time to time be determined by the mayor and city council by resolution." Section 304 is a Uniform Building Code fee section, and the editor's note under section 14-51 records that the title of that section was changed from "Adoption of Uniform Building Code" to "Adoption of International Building Code" by Ord. No. 1156 in 2010. So the amendment section is legacy text carried across the change of code and its numbering does not match the codes now adopted. Ask the Building Inspector at City Hall which text the City applies before relying on either.
Impact-resistant roofing
Not required — Minden requires no impact-rated or Class 4 roof covering. Chapter 14 of the Code of the City of Minden was read for this record across its general provisions, its whole building-code article and its housing code, and none of it contains an impact-resistance provision, a reference to UL 2218 or FM 4473, or a Class 4 or Class IV impact classification. The City adopts the 2018 International Residential Code and the 2018 International Building Code at section 14-51 and strikes only R313 and section 903, both fire provisions, and the only other amendment in the article is the legacy fee and Part IV text at section 14-56, so there is no local layer in which such a requirement could sit. Nebraska imposes none either: the State Building Code sets an edition floor rather than a content floor, and a Nebraska city may amend, modify or delete portions of the code it adopts. Note that a Class 4 rating measures impact resistance under UL 2218 and is a different thing from the Class A, B or C fire ratings that appear in roofing sections, and different again from the wind ratings under ASTM D3161 and D7158. South central Nebraska takes hail and an insurer may discount a premium for an impact-rated roof, but an insurance discount is not a code requirement and Minden has not made it one.

7.5% combined, made up of the Nebraska state rate of 5.5% and a City of Minden local-option rate of 2.0%, effective July 1, 2026, per the Nebraska Department of Revenue's Local Sales and Use Tax Rates schedule. Kearney County levies no county sales tax. Dakota County is the only Nebraska county carrying a county rate on that schedule, and its 0.5% applies only outside a municipality that imposes its own local tax, so it never reaches a Minden job. Minden is at the top of the Nebraska local range at 2.0%, while several nearby smaller places are at 1.0% or 1.5%, so on rural work in Kearney County outside any town the sale may be at the state rate alone - check the delivery address rather than the office address.
