City of Kearney, NE - Building Services Division

Yes — a permit is required to replace a roof in Kearney, NE, issued by City of Kearney, NE - Building Services Division. Register before you start, then apply online. Kearney's Building Services Division states that "All plumbers, electricians and building contractors performing work in the City's jurisdiction are required to register with the Building Services Division prior to starting work," and City Code section 9-206 puts it in ordinance: "anyone applying for a building permit shall be considered a building contractor and shall be registered with the City. Homeowners working on their primary residence shall not be considered a building contractor." Section 9-207 allows the City to suspend a contractor's registration for continued code or zoning violations until the violations are corrected. Applications and plan review run through the City's CitizenServe portal, which Building Services links from its own Building Information page. The roofing permit is priced on the City's Development Services Fee Schedule at the minimum permit fee, and section 9-302 item (6) doubles the fee where the work starts before the permit issues. A separate point that catches out-of-town crews: section 9-201 applies this code not only inside the city limits but "within two (2) miles thereof," so a job just outside Kearney can still be a Kearney permit.

Adopted code
Kearney City Code section 9-210 ("International Building Code; Adoption") adopts "the building code known as the 'International Residential Code, 2021 Edition and the International Building Code, 2021 Edition' recommended by the International Code Council, and the whole thereof except such portions as are hereinafter deleted, modified or amended," and applies it "within the corporate limits of the City and within two (2) miles thereof." The current editions came in by Ordinance No. 8593, section 2, adopted August 9, 2022. Section 9-211 adopts the 2021 International Property Maintenance Code (Ord. No. 8593, section 3) and section 9-213 the 2018 International Energy Conservation Code (Ord. No. 8484, adopted April 27, 2021, effective October 1, 2021). Kearney's local amendments are codified separately at sections 9-301 (International Building Code) and 9-302 (International Residential Code). Note section 9-212, which provides that subsequent editions of the International Building Code and International Property Maintenance Code are adopted "upon the approval thereof by the Council and the filing of one (1) copy thereof in the office of the City Clerk" -- so a later edition takes effect only on a further Council act, not automatically. Statewide context for a roofer working outside Kearney: Neb. Rev. Stat. 71-6403 adopts the 2018 International Residential Code (except section R313 and chapters 25 through 33) as the Nebraska state building code, and under 71-6406(1)(b) that state code applies in any county, city or village that has not adopted a local code, except for construction on a farm or for farm purposes.
Mid-roof inspection
Not required — Kearney publishes its inspection card as a Required Inspections sheet, which lists every inspection the permit holder must call for -- address identification sign, temporary electrical, footings, damp proofing, underfloor plumbing, curb cut, driveway approach and public sidewalk, framing, rough-in plumbing, rough-in electrical, gas piping, insulation, sewer or septic, permanent electrical service, and final inspection before occupancy. Read in full, it contains no roof inspection and no mid-roof or in-progress roofing stage, and Kearney's residential amendment list at City Code section 9-302 adds none. The sheet's own standing rules still apply to a roofing job: twenty-four hours' notice is required, same-day inspections are not guaranteed, and "NO INSPECTIONS WILL BE MADE UNTIL A PERMIT HAS BEEN ISSUED."
Impact-resistant roofing
Not required — Kearney adopts the 2021 International Residential Code and the 2021 International Building Code at City Code section 9-210. Neither its residential amendment list at section 9-302 nor its commercial amendment list at section 9-301 amends the roof-assembly chapters, and no UL 2218, Class 4 or Class IV impact-resistance requirement appears anywhere in the City's adopted code or its amendments. Nothing in Nebraska law supplies one either: Neb. Rev. Stat. 71-6403 adopts the 2018 International Residential Code as the state building code excepting only section R313 and chapters 25 through 33, so it does not touch the roof-assembly chapter. An insurance carrier may still discount an impact-rated roof in central Nebraska, but that is a policy question and not a Kearney code requirement.
Repair permit threshold
There is no small-job exemption in Kearney, and that is a deliberate local change rather than an oversight. Kearney adopts the 2021 International Residential Code and then, at City Code section 9-302, item (5), provides that "Section 105, Paragraph 105.2, Work Exempt from Permit of the Code is hereby deleted and repealed." Item (5) of the parallel commercial amendment list at section 9-301 deletes the same paragraph from the International Building Code. Those paragraphs are the model code's own lists of work that may be done without a permit, so once they are repealed no dollar figure, square footage or scope of work is exempt on its face. The City prices the permit accordingly: its Building Permit Fee Schedule opens with "Minimum permit fee and roofing permit $59.00," a roofing permit named on its own line at the minimum fee. Get the permit before the tear-off. Section 9-302 item (6) also warns that where work requiring a permit is started before the permit is obtained, the fee "shall be doubled," and that paying the double fee does not excuse compliance with anything else.
Roof layer limit / recover
Kearney states no roof-layer rule of its own. The City adopts the 2021 International Residential Code at City Code section 9-210, and its residential amendment list at section 9-302 -- forty-one numbered items, read in full -- adds, amends or deletes nothing in Part III Chapter 9, Roof Assemblies. Items (36) through (41) delete whole parts of the code by name (Energy Conservation, Mechanical, Fuel Gas, Plumbing, Electrical and twenty-one appendix chapters), and Chapter 9 is not among them, so the base 2021 IRC reroofing and roof-recover provisions govern in Kearney unmodified. The parallel commercial list at section 9-301 -- twelve items, read in full -- likewise leaves International Building Code Chapter 15 untouched. Ask Building Services which condition applies to your existing roof before bidding a recover rather than a tear-off.
Deck & sheathing requirements
No local variation applies. Kearney amends the structural framing side of the 2021 International Residential Code in several places -- section 9-302 item (30) rewrites Table R403.1 footing dimensions, items (31) through (33) rewrite the floor-joist span provisions of R502, and items (34) and (35) rewrite the deck footing provisions of R507 -- but nothing in the forty-one-item list reaches Part III Chapter 9, Roof Assemblies. The base 2021 IRC roof-deck and sheathing provisions therefore apply in Kearney as published, with no Kearney amendment to read alongside them.

The permitting authority for the City of Kearney, Nebraska, and for the two miles of territory outside the city limits that its building code also reaches. Building Services is a division of Kearney's Development Services Department and enforces the adopted zoning, building, electrical and plumbing codes. The one thing a roofer must know before quoting here: Kearney has repealed the model code's list of work exempt from permit outright, so there is no small-job exemption of any kind, and the City's fee schedule prices a roofing permit on its own line at the minimum permit fee.
