Section 50-6,122(a)(2) excludes a person doing demolition or debris cleanup, "a person working under the direct supervision of the roofing contractor and who is hired by such roofing contractor as an employee or day laborer," and an "exempt general contractor," a general contractor meeting the conditions of 50-6,122(e) (among them, that roofing is no more than 50% of the project cost, or that roofing is subcontracted to a registered roofer, and no door-to-door sales). Working unregistered carries civil penalties under K.S.A. 50-636 (50-6,123(b)).
  • city_level: The city's Building & Inspections page states: "Homeowners can work on their own homes; however, any contractor you hire must hold a Johnson County Contractor's license, with the exception of fence and irrigation contractors." Ordinance No. 2674 enacts the rule as Building Code Section 105.1.3: "All persons undertaking work which requires a permit" from the City, apart from fences, owner-occupants of one- and two-family structures and other ancillary structures the Building Official determines, "are required to have a current valid Johnson County contractor's license".
Adopted code
The city's Building & Inspections page lists the 2018 International Residential Code among the codes "adopted September 8, 2020, and effective November 1, 2020, by Ordinance No. 2674." Ordinance No. 2674, Section Eight, enacts Gardner Municipal Code 15.50.010: "The International Residential Code for One- and Two-Family Dwellings, 2018 Edition, including Appendix Chapters E, F, I, Q, and the referenced standards in Chapter 44, published by the International Code Council, is hereby adopted by reference as the Residential Code of the City of Gardner, Kansas". Local amendments follow in 15.50.020, items A through RR.
Drip edge
Required — Drip edge is required at eaves and rake edges of shingle roofs (IRC R905.2.8.5). The City adopted the 2018 International Residential Code via Ordinance No. 2674 (Gardner Municipal Code 15.50.010 and 15.50.020); that instrument, read in full, does not amend R905.2.8.5, so the code's drip-edge requirement stands as enacted local law. Its only Chapter 9 amendments are items BB (adding R905.4.2, shingle wind rating) and CC (amending R908.3, roof replacement). About drip edge
Ice & water shield
Required — Table R301.2(1) as amended by Gardner Municipal Code 15.50.020 K (Ordinance No. 2674) answers yes to ice barrier underlayment required. Item CC, amending Section R908.3, adds for every re-roof: "All re-roofing shall require two courses of ice and water." Its exception: "Where the existing roof assembly includes an ice barrier membrane that is adhered to the roof deck, the existing ice barrier membrane shall be permitted to remain in place and covered with an additional layer of ice barrier membrane in accordance with Section R905." About ice & water barrier
Impact-resistant roofing
Not required — Ordinance No. 2674 (passed September 8, 2020, effective November 1, 2020) was read in full, Sections One through Nine: the Building, Electric, Fire, Fuel Gas, Housing, Mechanical, Plumbing and Residential Code chapters (15.05 through 15.50), including every Residential Code amendment, items A through RR of 15.50.020. Counts across the whole ordinance: "UL 2218" 0, "Class 4" 0, "hail" 0, "impact" 3, all three in the Fire Code chapter about vehicle impact protection. No provision requires impact-resistant roof coverings.
Wind design criteria
Table R301.2(1), Climatic and Geographic Design Criteria, as amended by Gardner Municipal Code 15.50.020 K (Ordinance No. 2674): ground snow load 20 psf; wind design speed 115 mph; topographic effects no; special wind region no; windborne debris zone no; seismic design category A; weathering severe; frost line depth 36 inches; termite moderate to heavy; winter design temperature 6; ice barrier underlayment required yes; air freezing index 824; mean annual temperature 54.8. Item BB adds Section R905.4.2: "Asphalt shingles shall be listed and warrantied by the manufacturer to withstand a minimum 115 mile per hour wind load."
Roof layer limit / recover
Gardner Municipal Code 15.50.020 CC (Ordinance No. 2674) amends Section R908.3 of the 2018 International Residential Code, Roof replacement, to read: "New roof covering shall not be installed without first removing all existing layers of roof covering down to the roof decking." A roof recover over an existing layer is therefore not allowed in Gardner; every re-roof is a tear-off to the deck.
Sales & use tax
Gardner's combined sales tax rate is 9.475% (Kansas state 6.5% + Johnson County 1.475% + City of Gardner 1.5%), per the Kansas Department of Revenue's Pub. 1700 jurisdiction rate table effective October 1, 2026. Pub. 1700 also lists 2 special districts inside the city (community improvement, transportation development or STAR bond districts); 2 of them carry a higher combined rate at their listed addresses. Per KDOR Pub. KS-1525, "Services performed to install or apply tangible personal property are exempt from sales tax when the services involve the original construction, reconstruction, restoration, remodeling, renovation, repair or replacement of a residence," so residential re-roof labor is exempt. Materials are not: contractors "are considered to be the final user or consumer of the materials they install for others, and must pay Kansas sales or use tax on them."
