STATE-BASED, LOCALLY AMENDABLE - NOT a preemptive statewide code. North Dakota has no building code that binds every municipality. NDCC 54-21.3-03(4) provides that the governing body of a city, township, or county "that elects to administer and enforce a building code shall adopt and enforce the state building code," and adds that "the state building code may be amended by cities, townships, and counties to conform to local needs." North Dakota therefore has a single state-authored base code but, unlike Minnesota, no preemption of local amendment - a Fargo-specific amendment can lawfully displace a state provision, so state text alone does not settle a Fargo question. Fargo is an electing jurisdiction: it runs an Inspections Department and carries the International Building Code as Chapter 21 of the Fargo Municipal Code, and publishes its adopted code list on its Inspections "Current Codes" page. The North Dakota State Building Code itself is assembled by the Department of Commerce, Division of Community Services together with the State Building Code Advisory Committee under NDCC 54-21.3-03(1), and is published through the North Dakota Administrative Code (Article 108-01) rather than hard-coded into the Century Code. The edition published as the North Dakota State Building Code effective January 1, 2023 was built on the 2021 International Building Code, 2021 International Residential Code and 2021 International Energy Conservation Code, plus the 2020 National Electrical Code, as modified by the North Dakota amendments; where a North Dakota amendment conflicts with model-code text, the state amendment governs. That is no longer Fargo's operative edition. Fargo's own Inspections "Current Codes" page now lists a newer local adoption: the 2024 International Building Code, 2024 International Residential Code, 2024 International Existing Building Code, 2024 International Energy Conservation Code, 2024 International Property Maintenance Code, 2024 International Mechanical Code and 2024 International Fuel Gas Code, each carrying a "Local Amendment," effective July 2, 2025; plumbing remains the 2018 North Dakota State Plumbing Code (Uniform Plumbing Code) and electrical is the 2023 National Electrical Code with 2023 North Dakota wiring standards, both effective July 1, 2024. Fargo Municipal Code Chapter 21.1 (International Residential Code) was re-adopted under this newer edition by Ordinance No. 5493 (2025); the roofing-relevant Table R301.2 (Climatic and Geographic Design Criteria) is a Fargo-specific local amendment printed in Fargo Municipal Code Section 21.1-0102. Separately, the North Dakota Department of Commerce reports that eligible cities, counties and the State Building Code Advisory Committee voted to adopt the 2024 updates to the IBC, IRC, IMC and IFGC on September 11, 2025, with the new statewide North Dakota State Building Code taking effect January 1, 2026 - so Fargo's July 2025 local adoption of the 2024-family codes preceded, and now aligns in ICC vintage with, that incoming statewide edition.

Required — Sourced from Fargo's own local amendment to the International Residential Code, not inferred from climate. Fargo Municipal Code Section 21.1-0102 amends Table R301.2 (Climatic and Geographic Design Criteria), and its printed "Ice Barrier Underlayment Required" column reads "Yes" for Fargo. The amended table does not itself restate the extent of the ice barrier (that is Section R905.1.2 of the International Residential Code, which Fargo's amendment ordinance does not touch), so the required distance the barrier must extend up the roof slope is governed by the unamended 2024 IRC text rather than by a Fargo-specific rule.

Not required — Scoped to residential re-shingling, and following directly from that work's permit-exempt status rather than from a separate inspection rule: the Fargo Inspections Department FAQ states permits are not required for "replacing/covering shingles," and with no permit issued there is no city deck, underlayment, or in-progress roof inspection to schedule on such a job - no inspector needs to see the deck before it is covered. This does not extend to work that IS permitted in Fargo (the City's permitting portal carries a "Reroof or tear-off project" permit type, and commercial re-roofing is permitted work); inspections on permitted work are set by the terms of that permit and by the North Dakota State Building Code as administered by Fargo, and are not established in this record.

Not required — No impact-resistance mandate applies in Fargo. Fargo Municipal Code Section 21.1-0102 - the city's full set of amendments to the 2024 International Residential Code - contains no amendment to Chapter 9 (Roof Assemblies) and no UL 2218 or Class 4 impact-rating reference anywhere in its text. The North Dakota Administrative Code 108-01, Section 11 ("2021 International Residential Code Amendments") - the state's own list of its amendments to the prior IRC edition - likewise contains no Chapter 9 or roof-covering amendment. Neither the city's nor the state's adopted amendments impose an impact-resistant shingle requirement.

CITY-SPECIFIC, AND UNUSUALLY PERMISSIVE - there is no dollar or square-foot repair threshold to clear in Fargo for ordinary shingle work, because the work is not permitted work at all. The City of Fargo Inspections Department's own published FAQ states: "We do not require permits for finish work (such as new cabinets), painting or replacing/covering shingles, or for flat work." The same FAQ answer lists the neighbouring homeowner projects that DO need a permit - Sheetrock, siding, stairs/steps, and a deck - which places re-shingling deliberately on the no-permit side of the line rather than leaving it unaddressed. Two limits on that exemption a roofer should plan around: (1) the exemption as written covers "replacing or covering shingles," i.e. the roof covering itself, and does not on its face reach structural work such as replacing roof framing or sheathing; and (2) the City's online permitting portal does carry a "Reroof or tear-off project" permit type alongside its other building permit types, which is consistent with tear-off work and commercial re-roofing remaining permitted work even where residential re-shingling is exempt. Confirm scope with Fargo Inspections before relying on the exemption for a tear-off, for a commercial roof, or for any job that disturbs framing or sheathing. Fargo's own Finance Department FAQ states: "The total sales tax collection rate is 7.75% which consists of 5% State of North Dakota, 2.25% The City of Fargo and .5% for Cass County." The same FAQ states that changes to the City of Fargo's rate require a public vote, and that of the city's 2.25%, 1.25% is allocated to flood control projects, 0.75% to other infrastructure categories, and 0.25% to public safety.
