NDCC 54-21.3-03(4) provides that the governing body of a city, township, or county "that elects to administer and enforce a building code shall adopt and enforce the state building code," and adds that "the state building code may be amended by cities, townships, and counties to conform to local needs." North Dakota therefore has a single state-authored base code but, unlike Minnesota, no preemption of local amendment - a Fargo-specific amendment can lawfully displace a state provision, so state text alone does not settle a Fargo question. Fargo is an electing jurisdiction: it runs an Inspections Department and carries the International Building Code as Chapter 21 of the Fargo Municipal Code, and publishes its adopted code list on its Inspections "Current Codes" page. That licence is issued by the North Dakota Secretary of State, not by a trade board, and the Secretary of State issues it in classes keyed to the contract value a holder may undertake (the class dollar bands are not restated here). Roofing is not named as its own word in the statute but falls squarely inside the NDCC 43-07-01 definition of "contractor," which reaches any person engaged in the business of "construction, repair, alteration, dismantling, or demolition of ... buildings ... and every other type of structure, project, development, or improvement coming within the definition of real or personal property," and expressly "includes subcontractor, public contractor, and nonresident contractor." (2) CITY, mandatory above $500 per job - eight times stricter than the state trigger: Fargo Municipal Code Chapter 25 (Licensing and Regulating Businesses and Trades), Article 25-37 (Re-Roofing Contractors) provides that a person may not engage in the business nor act in the capacity of a re-roofing contractor within the City of Fargo when the cost, value or price of any job exceeds the sum of five hundred dollars without first having a licence. To obtain it the applicant must be eighteen years of age or older and must submit an application giving the address and telephone number of the principal place of business together with a statement of the applicant's experience and qualifications, and must establish that the applicant holds a valid North Dakota state contractor's licence - so the city licence sits on top of the state licence and is not an alternative to it. Under Fargo Municipal Code 25-3702 the licence fee and its period of expiration are set by resolution of the board of city commissioners rather than fixed in the ordinance text; the City Auditor's own published fee schedule currently lists the Re-Roofing licence fee as $125 per year, expiring December 31. The licence is administered by the City Auditor's Licensing Department, not by Inspections. PRACTICAL EFFECT: the regulatory weight in Fargo sits on the contractor, not on the job.
