City of Fairview Heights Building Permits and Inspections Department

Building permits in the City of Fairview Heights, Illinois, in St. Clair County, are issued by the City's Building Permits and Inspections Department, part of Land Use and Development, at 10025 Bunkum Road. The Illinois Capital Development Board says "The State has not adopted a building code for repairs to existing single family residences," so Fairview Heights's roofing rules are its own: Chapter 7 of the City's Code of Ordinances, which the City posts on its own site, adopts the 2021 International Residential Code with a short list of City changes. This listing covers the office's contact details, the City's own statements on code and permits, and the rules state law sets for every Illinois roofer.

  • state_level: Illinois licenses roofing contractors statewide with no dollar threshold. 225 ILCS 335/9(2): "No work involving the construction, reconstruction, alteration, maintenance, or repair of any kind of roofing or waterproofing may be done except by a roofing contractor or a qualifying party licensed or credentialed under this Act." Under 225 ILCS 335/5(a-3), "A municipality or a county that requires a building permit may not issue a building permit to a roofing contractor unless that contractor has provided sufficient proof of current licensure as a roofing contractor by the State," and a holder of a limited license is restricted to permits for work on residential properties of 8 units or less. The Illinois Department of Financial and Professional Regulation lists "Roofing Contractor, Licensed" among the professions it licenses.
Permit process note
The City's Permits page says "The Building Permits and Inspections Department handles the issuance of all building permits and occupancy permits for residential and commercial properties" and "Building permits shall be obtained prior to making improvements or alterations to a property. If you have any questions if your project will require a permit, please contact us." Section 7-2-7 of the City Code says "Any person, firm or corporation desiring or intending to make any improvements or construct any building or structure in the City shall file an application with the Director of Land Use and Development for a permit to do so, prior to initiating any such work," and that if work starts before a permit issues, "all permit fees, as prescribed in Section 7-1-3 of this chapter, shall be doubled." Neither the page nor the Code names roof replacement in terms, so this listing does not state a yes or no answer for a re-roof. The Code's table of fees sets a "Minimum permit fee residential" of $50, and Section 7-1-3 says a fee that "cannot be calculated on the basis of square footage" is charged the minimum fee.
Adopted code
THE 2021 INTERNATIONAL RESIDENTIAL CODE WITH CITY CHANGES, PER CHAPTER 7 OF THE CITY CODE AS THE CITY POSTS IT. Section 7-2-3 says "The International Residential Code for One- and Two-Family Dwellings, 2021, as published by the International Code Council, is hereby adopted as the building code for detached one- and two-family dwellings," and that it shall "regulate the construction, alteration, enlargement, replacement, maintenance, removal and demolition of residential buildings." Section 7-2-4 lists the City's changes to that code: it inserts the City's name in R101.1, fills in Table R301.2, and says "Delete Section § R313 Automatic Fire Sprinkler Systems." It makes no change to the code's roof provisions. Section 7-2-5 adopts the 2021 International Existing Building Code. The City's Permits page lists the "2021 International Residential Code (supplements thereto adopted by City of Fairview Heights)." The copy read is the complete Code of Ordinances the City posts, with Chapter 7 marked Supplement No. 100, 02-01-25.
Ice & water shield
Required — REQUIRED, IN THE CITY'S ENACTED TABLE. Section 7-2-4 of the City Code fills in Table R301.2 of the 2021 International Residential Code, and the table's Ice Barrier Underlayment Required column reads Yes. This rests on the text of Chapter 7 as the City posts it on its own site. About ice & water barrier
Impact-resistant roofing
Not required — NOT REQUIRED BY THE CITY'S BUILDING CHAPTER. Chapter 7 of the City Code, Building Code Regulations, as the City posts it, was read in full, including every change it makes to the building, residential, existing building, electrical, mechanical, fuel gas, plumbing, fire, pool and energy codes, and contains no UL 2218, Class 4, hail or impact resistance requirement for roof coverings.
Wind design criteria
Section 7-2-4 of the City Code fills in Table R301.2 of the 2021 International Residential Code: ground snow load 20 lbs/sq ft; wind design speed 115 mph, with topographic effects, special wind region and wind-borne debris zone each marked No; seismic design category C; weathering Severe; frost line depth 32 inches; termite damage Moderate to Heavy; winter design temperature 6 degrees F; air freezing index 880; mean annual temperature 55.3; flood hazards Yes, with a reference to Chapter 18 of the City Code.
Sales & use tax
Illinois taxes the roofer, not the job, and the operative rate is not keyed to the Fairview Heights job address. Under 86 Ill. Adm. Code 130.1940(c), a construction contractor "does not incur Retailers' Occupation Tax liability as to receipts from labor furnished and tangible personal property (materials and fixtures) incorporated into a structure," but "incurs Use Tax on the cost price of the tangible personal property that is incorporated into real estate," with "roofing materials" named in the rule's own list of examples. Repair and replacement are taxed identically: 130.1940(a)(3) defines "construct" to include "repair, renovate or remodel." The Illinois Department of Revenue states the Use Tax rate as "6.25% of the purchase price or fair market value, whichever is greater." Where the contractor buys for resale, the local tax follows "the place of business at or from which the contractor or builder handles the transaction" (130.2075(b)(3)), so the combined rate on materials is the supply house's or the contractor's, which this record does not pin down. The authoritative lookup is the Illinois Department of Revenue's MyTax Illinois Tax Rate Finder.
