  • city_level: Section 4-304 of the Code of the City of Council Grove: "No person, other than a duly licensed contractor, shall engage in the building construction trade within the limits of the City or the Council Grove Lake Park." Permit process note
Section 4-305 of the Code of the City of Council Grove: "Any person who intends to construct, enlarge, alter, repair, move, demolish or change the occupancy of a one- or two-family dwelling, and all structures accessory to the dwelling, or to cause any such work to be done, shall first make application for a Building Permit from the city clerk of the city." Section 4-306 then states that building permits "shall not be required" for, at item (d), "Roofing and siding where no other work requiring a building permit is being done," and, at item (c), "Repairs where no major structural repairs are being made to the building or improvement." Section 4-303(b) replaces the exemption list of IRC Section R105.2 with Section 4-306.
Adopted code
Section 4-302 of the Code of the City of Council Grove (Ord. 2236) incorporates by reference "The International Residential Code, edition of 2015 including appendix chapters A, B, C, D, E, F, G, H, I, J, K, M, N, P & Q; as published by the International Code Council," save the revisions set out in Section 4-303. Under Section 4-301 the article applies to all one- and two-family dwellings and their accessory structures within the city and the Council Grove Lake Park. Section 4-303 revises Sections R101.1, R105.2, 108.2, R112, R113.4, 108.5, Table R301.2(1), R313.2, N1101.9, P2603.5.1 and Part VIII (Electrical); it does not revise any section of IRC Chapter 9.
Drip edge
Required — Drip edge is required at eaves and rake edges of shingle roofs (IRC R905.2.8.5). The City adopted the 2015 International Residential Code via Section 4-302 of the Code of the City of Council Grove (Ord. 2236); that instrument, read in full (Chapter IV, Article 3, Sections 4-301 through 4-309, including the revisions at Section 4-303, items (a) through (k)), does not amend R905.2.8.5, so the code's drip-edge requirement stands as enacted local law. About drip edge
Impact-resistant roofing
Not required — Chapter IV, Article 3, Residential Code, of the Code of the City of Council Grove, Kansas, read in full (Sections 4-301 through 4-309, including the adoption of the 2015 International Residential Code at Section 4-302 and its revisions at Section 4-303). Counts across that whole article: "UL 2218" 0, "Class 4" 0, "impact" 0, "hail" 0. The revisions change no provision of IRC Chapter 9 (Roof Assemblies), so no impact-resistant roof covering is required by local law.
Roof layer limit / recover
Base-code rule, read at 2015 International Residential Code Section R908.3.1.1, Roof recover not allowed, and quoted here rather than left behind the ICC paywall: a roof recover "shall not be permitted" where "the existing roof has two or more applications of any type of roof covering." One existing layer may be recovered; a second existing layer means a tear-off to the deck. The City's revisions to the 2015 IRC (Section 4-303, items (a) through (k)) do not touch Sections R907 or R908.
Sales & use tax
Council Grove's combined sales tax rate is 9.2% (Kansas state 6.5% + Morris County 1% + City of Council Grove 1.7%), per the Kansas Department of Revenue's Pub. 1700 jurisdiction rate table effective October 1, 2026. Per KDOR Pub. KS-1525, "Services performed to install or apply tangible personal property are exempt from sales tax when the services involve the original construction, reconstruction, restoration, remodeling, renovation, repair or replacement of a residence," so residential re-roof labor is exempt. Materials are not: contractors "are considered to be the final user or consumer of the materials they install for others, and must pay Kansas sales or use tax on them."
