The building permitting authority for the City of Waukegan, Illinois, the seat of Lake County, working out of City Hall at 100 N Martin Luther King Jr. Avenue. The City requires a permit for essentially all roofing work, runs its own roofing-contractor registration on top of the statewide roofing licence, and adopted the 2021 International Residential Code and 2021 International Building Code by Ordinance No. 22-O-44 and Ordinance No. 22-O-17, each dated 2022, with a long local amendment list. The City's own Table R301.2(1) sets a 115 mph design wind speed and requires ice barrier underlayment, and its Roofing permit page separately states a 24-inch minimum. The City states plainly that no inspection is required on a roofing job.

  • state_level: A STATEWIDE ROOFING LICENCE WITH NO DOLLAR THRESHOLD. The Illinois Roofing Industry Licensing Act, 225 ILCS 335/9(2), reads: "No work involving the construction, reconstruction, alteration, maintenance, or repair of any kind of roofing or waterproofing may be done except by a roofing contractor or a qualifying party licensed or credentialed under this Act." Section 5(a-3) adds the permit gate: "A municipality or a county that requires a building permit may not issue a building permit to a roofing contractor unless that contractor has provided sufficient proof of current licensure as a roofing contractor by the State." The licence comes in two classes (225 ILCS 335/2(h), (i)): a limited licence for residential properties of eight units or fewer, and an unlimited licence for residential, commercial and industrial work, each requiring liability and workers' compensation insurance and a $10,000 (limited) or $25,000 (unlimited) surety bond (225 ILCS 335/3(2)). None of the Act's exemptions (own property, no consideration, an employee of the owner, greenhouses, farm buildings) reaches an ordinary paid residential reroof.
  • city_level: A SEPARATE ANNUAL CITY REGISTRATION, ON TOP OF THE STATE LICENCE. The City's Roofing permit page requires roofing contractors to be "registered with the City of Waukegan and provide a copy of their State of Illinois License," and lists as required: a certificate of insurance with $2,000,000 general aggregate comprehensive liability, proof of workers' compensation, the City of Waukegan named as certificate holder, a copy of the State of Illinois Roofing License, a $100.00 annual registration fee, a notarized letter of authorization signed by the license holder, and a letter on company letterhead listing employees. The City's own List of Contractor Requirements per Trade page shows two roofing sub-categories, described there as requiring a copy of the "058" or the "055" State of Illinois License respectively, each with the same $100.00 fee and insurance certificate. The codified version, Article XIV Section R116 (Sec. 6-402, Ord. No. 22-O-44), requires the same $100.00 general-contractor registration fee (or $60.00 for a specialty contractor), the same insurance schedule, and states that "only the owner of property or a contractor registered as below shall be entitled to perform contract work in the city." Registration expires December 31 of the year issued (Contractor Information page; R116.5.3).
Adopted code
THE 2021 INTERNATIONAL RESIDENTIAL CODE FOR ONE- AND TWO-FAMILY DWELLINGS, ADOPTED BY ITS OWN ARTICLE WITH A LONG LOCAL AMENDMENT LIST, AND A SEPARATE 2021 IBC FOR OTHER BUILDINGS. Code of Ordinances Sec. 6-401 (Article XIV, One- and Two-Family Dwelling Code; Ord. No. 22-O-44, Section 7, adopted April 18, 2022): "A certain document ... marked and designated as 'The International Residential Code, 2021 Edition' ... be and is hereby adopted as the One- and Two-Family Dwelling Code[.]" Sec. 6-402 amends roughly sixty individual IRC sections and tables, none of them R907 or R908 (the roof re-cover sections) and exactly one of them in Chapter 9: it adds "R901.2 Concealed areas. Roofing materials shall be removed down to roof deck in concealed areas." Separately, Code of Ordinances Sec. 6-26 (Article II, Building Code; Ord. No. 22-O-17, Section 2, 3-7-2022) adopts "The International Building Code, 2021 Edition" for buildings generally, with its own amendment list at Sec. 6-27 (also silent on Chapter 9). The City's own Contractor Information page lists both, plus the 2020 NEC, the current Illinois Plumbing Code, 2021 IPMC, the Illinois Energy Efficient Building Act, 2021 IFGC, 2021 IMC and 2021 IFC, as "Approved Codes - Effective 4/1/2022." Illinois itself has adopted no residential building code reaching an existing dwelling (Illinois Capital Development Board FAQ: "The State has not adopted a building code for repairs to existing single family residences"), so the 2021 IRC and its local amendments are the whole of the applicable code here, not a floor under a state default.
Drip edge
Required — NOT ITSELF AMENDED BY THE CITY, SO THE BASE 2021 IRC RULE APPLIES. Article XIV's amendment list (Sec. 6-402, read in full) does not touch R905.2.8.5, the drip edge section, or any other part of R905. Ice & water shield
Required — REQUIRED, AND THE CITY GIVES TWO CONSISTENT ANSWERS. The Roofing permit page's own "ADDITIONAL ROOFING REQUIREMENTS" state plainly: "MINIMUM OF 24" OF ICE AND WATER SHIELD IS REQUIRED." Separately, the City's local Table R301.2(1) (Sec. 6-402, Ord. No. 22-O-44) inserts "Ice Barrier Underlayment Required ... Yes" alongside a Ground Snow Load of 30 and a Winter Design Temperature range of 68 degrees F to -10 degrees F. Mid-roof inspection
Not required — THE CITY'S OWN ROOFING PERMIT PAGE STATES IT OUTRIGHT. Under "INSPECTION REQUIREMENTS" the Roofing page reads, in full: "NO INSPECTIONS REQUIRED." No tear-off, dry-in or final inspection is called for on a roofing permit; the City instead requires the permit placard to stay posted and visible from the street during construction.
Impact-resistant roofing
Not required — NO IMPACT-RATING REQUIREMENT APPEARS IN THE CITY'S OWN AMENDMENT LIST. Article XIV's roughly sixty amendments to the 2021 IRC (Sec. 6-402, read in full) contain no occurrence of UL 2218, Class 4, Class IV or hail; the local Table R301.2(1) inserts a design wind speed and seismic category but no impact-resistance column. Illinois itself imposes no such requirement statewide.
Repair permit threshold
NO FIXED DOLLAR OR SIZE FLOOR; THE BUILDING OFFICIAL DECIDES CASE BY CASE, AND A SEPARATE 50-PERCENT VALUE RULE CAN PULL A REPAIR UP TO NEW-CONSTRUCTION STANDARDS. The City's own Roofing permit page states: "Permits are required for all roofing work within the City of Waukegan (minor repairs may be exempt by order of the Building Official)." No square-foot or dollar figure is published for what counts as a minor repair; the exemption is discretionary with the Building Official on a case-by-case basis. Separately, the City's local amendment to the 2021 International Residential Code, R102.7.1 (Sec. 6-402, Ord. No. 22-O-44, Section 7, 4-18-2022), adds: "Additions, Alterations or Repairs exceeding 50 percent. If alterations or repairs are made within any period of 12 months, costing in excess of 50 percent of the physical value of the structure, this code's requirements for new structures shall apply." A reroof that combines with other work within twelve months to clear that 50 percent threshold is treated as new construction rather than a repair.
Wind design criteria
115 MPH, LOCALLY INSERTED INTO TABLE R301.2(1). Sec. 6-402 (Ord. No. 22-O-44, Section 7, 4-18-2022) amends Table R301.2(1) Climatic and Geographic Design Criteria by inserting, under each category: "Ground snow load ... 30", "Wind Speed ... 115", "Seismic Design Category ... A", "Weathering ... Severe", "Frost Line Depth ... 42 inches", "Termite ... Moderate to Heavy", "Winter Design Temperature for Heating Facility ... 68 F to -10 F w/50% humidity", "Ice Barrier Underlayment Required ... Yes", "Air Freezing Index ... 2000", and "Mean Annual Temperature ... 50 F." The same section separately replaces Table R301.6 Minimum Roof Live Loads with a City-specific table: 30 lbs. snow load plus 15 lbs. dead load for pitched roof rafters of 4 inches per foot or greater, 30 lbs. snow load plus 20 lbs. dead load for flatter rafters, and 30 lbs. snow load plus 10 lbs. top-chord and 10 lbs. bottom-chord dead load for manufactured roof trusses.
Roof layer limit / recover
TWO LAYERS MAXIMUM UNDER THE UNMODIFIED BASE 2021 IRC; THE CITY'S OWN AMENDMENT TOUCHES CHAPTER 9 BUT NOT THIS SECTION. Article XIV's amendment list (Sec. 6-402, Ord. No. 22-O-44, Section 7, 4-18-2022, read in full) adds exactly one Chapter 9 provision, "R901.2 Concealed areas. Roofing materials shall be removed down to roof deck in concealed areas," and does not touch R908.3.1.1, the roof re-cover section, at all. Under the unmodified 2021 International Residential Code, R908.3.1.1 bars a roof recover where, among other conditions, "the existing roof has two or more applications of any type of roof covering." One existing layer may be recovered; a second forces tear-off.
Deck & sheathing requirements
NOT AMENDED; THE UNMODIFIED 2021 IRC ROOF SHEATHING PROVISIONS APPLY. Article XIV's amendment list (Sec. 6-402, read in full, roughly sixty individual sections and tables) touches floor sheathing thickness (R503.2.1.1, R503.2.2, both three-quarter inch minimum) and a wall-stud spacing table (Table R602.3(5)), but no provision of Chapter 8 (roof-ceiling construction) or R803 (roof sheathing) appears anywhere in it. The base 2021 IRC's roof sheathing requirements therefore govern unmodified.
Sales & use tax
STATE 6.25 PERCENT ON MATERIALS ONLY, OWED BY THE CONTRACTOR, AT THE SUPPLIER'S OR THE CONTRACTOR'S OWN LOCATION -- NOT AT THE JOB ADDRESS. Illinois taxes a roof job as a construction contract rather than a retail sale: 86 Ill. Adm. Code 130.1940(c) provides that "a construction contractor does not incur Retailers' Occupation Tax liability as to receipts from labor ... and tangible personal property ... incorporated into a structure," and instead "incurs Use Tax on the cost price of the tangible personal property," with "roofing materials" named among the examples at 130.1940(c)(1). Repair and replacement are taxed identically: "Construct" is defined at 130.1940(a)(3) to mean "build, erect, construct, reconstruct, install, plant, repair, renovate or remodel." The combined rate that lands on the materials purchase is the one where the supply house or the contractor's own place of business sits, not the homeowner's address (86 Ill. Adm. Code 130.2075). The state rate has been 6.25 percent since January 1, 1990 (86 Ill. Adm. Code 130.101(c)(1)). For a Waukegan business location, SalesTaxHandbook lists a combined rate of 8.5 percent (6.25 percent state, 1.5 percent City of Waukegan, 0.75 percent Regional Transportation Authority); a second aggregator, SalesTaxGuide, lists 8.6 percent for the same ZIP code.
