No, Stafford County, VA does not require a permit for like-for-like roof replacement (Stafford County - Building Division, Department of Development Services). Two location branches come first: under Virginia Construction Code 108.2, "1. Application for a permit may be required by the building official for the installation of replacement siding, roofing and windows in buildings within a historic district designated by a locality pursuant to Section 15.2-2306 of the Code of Virginia." and "2. Application for a permit may be required by the building official for any items exempted in this section which are located in a special flood hazard area." Outside those, a shingle reroof of a house or townhouse is ordinarily done without a building permit in Stafford County: the Development Services FAQ lists "Residential re-roofing: Old shingle roof can be left in place provided that there are not more than two previous layers of shingles and that the existing shingles are not water saturated" under "The following work generally does not require a building permit: (Examples only; see USBC §108.2. Work must still comply with all applicable codes.)" That follows item "14.5. Replacement of an unlimited amount of roof covering or siding in Group R-3, R-4 or R-5 provided the building or structure is not in an area where the nominal design wind speed is greater than 100 miles per hour (44.7 meters per second) and replacement of 100 square feet (9.29 m2) or less of roof covering in all groups and all wind zones." A permit is needed where more than 256 square feet of decking is replaced or fire-rated decking is replaced (item "14.6. Replacement of 256 square feet (23.78 m2) or less of roof decking in Group R-3, R-4 or R-5 unless the decking to be replaced was required at the time or original construction to be fire-retardant-treated or protected in some other way to form a fire-rated wall termination."), and where rafters or other roof framing are removed or modified; the County's fee schedule prices that residential work as "Roof Replacement (structural not shingles)" plan review and inspection. An owner may always ask for a permit: "when an owner or an owner’s agent requests that a permit be issued for any of the following, then a permit shall be issued and any related inspections shall be required." The FAQ adds: "If you are unsure whether your project requires a permit, contact Development Services before beginning work." Where work that needed a permit was done without one, the FAQ says the responsible party "will be required to submit construction documents detailing the scope and extent of the work performed" for an after-the-fact permit and "may be required to remove or open concealed areas of construction to allow for inspection". Permits are applied for and inspections scheduled through the County's online portal (progress.staffordcountyva.gov); the Permits counter is at 1300 Courthouse Road, 540-658-8650. The FAQ also advises checking with the homeowners' association, since "HOA approval does not replace the requirement to obtain a building permit.".

- state_level: Virginia licenses contractors through the Board for Contractors. Code of Virginia 54.1-1100 (as amended in 2025): "Class C contractors" perform or manage construction, removal, repair, or improvements when (i) the total value referred to in a single contract or project is over $1,000 but less than $30,000, or (ii) the total value of all such construction, removal, repair, or improvements undertaken by such person within any 12-month period is less than $250,000. Classes B and A cover larger jobs. The Board's regulation defines "Roofing contracting" (ROC) as "the service that provides for the installation, repair, removal, or improvement of materials common to the industry that form a watertight, weather resistant surface for roofs and decks", and notes that the CBC and RBC classifications and the HIC and CIC specialties also provide for this function. Code of Virginia 54.1-1101 A 7 excludes "Any person who performs or supervises the construction, removal, repair, or improvement of no more than one primary residence owned by him and for his own use during any 24-month period". Under 54.1-1111 a permit applicant must furnish proof of licensure or "file a written statement that he is not subject to licensure or certification as a contractor or subcontractor pursuant to this chapter."
- county_level: Stafford County Code Chapter 6 (read in full) sets no roofing contractor licence of its own; its Article III certifies plumbers, electricians and building-related mechanical workers only. The County's residential permit applications ask for the "VIRGINIA CONTRACTORS LICENSE #", "LICENSE CLASS" and "LICENSE DESIGNATION", with the signer certifying that "(1) I am duly licensed under the Virginia Code to perform the work contemplated by this application". The County's FAQ ("Do I have to hire a contractor?") says: "If you meet the requirements for an exemption under Code of Virginia Title 54.1-1101, you may perform the work without hiring a licensed contractor." and "If you are applying for a permit as the property owner, you must complete and submit a notarized Affidavit of Owner." It also advises verifying a contractor's Virginia licence with the Department of Professional and Occupational Regulation (DPOR) before signing.

Adopted code
The 2021 Virginia Uniform Statewide Building Code (13VAC5-63), effective January 18, 2024, applies statewide; for one- and two-family dwellings and townhouses it incorporates the 2021 International Residential Code as amended by Virginia (the Virginia Residential Code), and existing buildings fall under the Virginia Existing Building Code. Virginia's statute provides that the USBC "shall supersede the building codes and regulations of the counties, municipalities and other political subdivisions and state agencies." Stafford County Code Sec. 6-16 (Chapter 6 read in full; Code of Ordinances codified through Ordinance No. O26-15, adopted June 16, 2026) provides that "The building code of the county shall be the Virginia Uniform Statewide Building Code", adopting the Construction Code (USBC, Part I) "in its entirety" with four insertions (at sections 1807.2.1 and 1807.2.2 of the building code and P-303.3 and P-308.3 of the plumbing code), the Existing Building Code (USBC, Part II) "in its entirety", and parts of the Maintenance Code; none of the insertions concerns roofing. The Building Division's Residential Building page states that the Commonwealth adopted the USBC, "which went into effect on January 18, 2024", and that "The USBC references the 2021 International Residential Code (IRC) as the official residential building code for Virginia." Its 2021 Building Code Cycle page states: "Beginning January 18, 2025, all Stafford County construction permit applications must be compliant with the 2021 VUSBC."
Ice & water shield
Required — Stafford County's Design Criteria page (Building Division, Codes and Standards) lists "ICE/WATER SHIELD REQUIRED Yes", and the Department of Development Services' "Ice Barrier and Drip Edge Requirements" sheet, a "Jurisdictional determination for ice shield and drip edge requirements" dated 8-8-17, states "Ice Barriers are required per the 2012 Virginia Residential Code (IRC with VUSBC amendments) per section 905.8.3.1". Both County statements name earlier code editions (the Design Criteria page says its criteria "are based on Chapter 16 of the 2018 Virginia Construction Code, the 2005 ASCE-7 and Chapter 3 of the 2018 Virginia Residential Code"); the 2021 Uniform Statewide Building Code now applies.
About ice & water barrier
Impact-resistant roofing
Not required — Virginia's 2021 Uniform Statewide Building Code amendments to the International Residential Code (13VAC5-63-210) contain no UL 2218 or Class 4 impact requirement for roof coverings, and that code supersedes local building codes (Code of Virginia 36-98). Stafford County Code Sec. 6-16 adopts the USBC with insertions only at sections 1807.2.1, 1807.2.2, P-303.3 and P-308.3, and the County's Design Criteria page and its Ice Barrier and Drip Edge Requirements sheet state no impact rating requirement. Insurer discounts for impact-rated shingles are not a code requirement.
Repair permit threshold
Virginia Construction Code 108.2 (2021 Uniform Statewide Building Code, 13VAC5-63, effective January 18, 2024) lists among ordinary repairs that need no permit application: "14.5. Replacement of an unlimited amount of roof covering or siding in Group R-3, R-4 or R-5 provided the building or structure is not in an area where the nominal design wind speed is greater than 100 miles per hour (44.7 meters per second) and replacement of 100 square feet (9.29 m2) or less of roof covering in all groups and all wind zones." and "14.6. Replacement of 256 square feet (23.78 m2) or less of roof decking in Group R-3, R-4 or R-5 unless the decking to be replaced was required at the time or original construction to be fire-retardant-treated or protected in some other way to form a fire-rated wall termination." Its Exceptions: "1. Application for a permit may be required by the building official for the installation of replacement siding, roofing and windows in buildings within a historic district designated by a locality pursuant to Section 15.2-2306 of the Code of Virginia." and "2. Application for a permit may be required by the building official for any items exempted in this section which are located in a special flood hazard area." The same section provides: "when an owner or an owner’s agent requests that a permit be issued for any of the following, then a permit shall be issued and any related inspections shall be required." Stafford County Development Services' FAQ "Do I need a building permit?" (residential projects; "The information below applies to one- and two-family dwellings and townhouses.") lists, under "The following work generally does not require a building permit: (Examples only; see USBC §108.2. Work must still comply with all applicable codes.)", the entry "Residential re-roofing: Old shingle roof can be left in place provided that there are not more than two previous layers of shingles and that the existing shingles are not water saturated". The same FAQ lists among work for which "A building permit is generally required" the item "Removing, relocating, or modifying load-bearing walls or other structural members, including foundations, footings, columns, beams, girders, joists, rafters, and roof framing." Replacing more than 256 square feet of roof decking, or decking that was required to be fire-rated, falls outside item 14.6 and needs a permit. The County's fee schedule (Ordinance O24-16, adopted September 17, 2024, effective November 1, 2024) prices residential roof work only as "Roof Replacement (structural not shingles) Plan Review" and "Roof Replacement (structural not shingles) Inspection", each "$0.04/sq. ft.; $50 minimum"; its commercial section lists "Roof Repair or Replacement (shingles only)" at "$0.11/sq. ft.; $119 minimum". The County's Fees page states that work the USBC exempts from application for permit (USBC 108.2) is "exempt from all applicable building fees." The County's Design Criteria page lists wind speed as "115 miles per hour three second gust" and "89 miles per hour fastest wind speed" and does not call either figure the nominal design wind speed that item 14.5 uses; this record does not convert either figure. The County's Residential Changes permit application (form RESCHG 06-21-21) includes a "Roof" box among its project types.
Wind design criteria
Stafford County's Design Criteria page (Building Division, Codes and Standards) lists: ground snow load 25 psf; wind speed "115 miles per hour three second gust" and "89 miles per hour fastest wind speed"; earthquake spectral response .16 at short periods; residential seismic design category B; weathering probability for concrete Severe; termite infestation probability Moderate to Heavy; decay probability Moderate; ice/water shield required Yes; winter design temperature 17 degrees Fahrenheit; air freezing index less than or equal to 1500 degrees F; frost depth 24 inches; mean annual temperature 50 degrees Fahrenheit. The page states: "The following load criteria are based on Chapter 16 of the 2018 Virginia Construction Code, the 2005 ASCE-7 and Chapter 3 of the 2018 Virginia Residential Code." The 2021 Uniform Statewide Building Code now applies. The page does not say whether either wind figure is the nominal or the ultimate design wind speed, and this record does not convert between them.
Roof layer limit / recover
Stafford County Development Services' FAQ lists, among work that generally does not require a building permit, "Residential re-roofing: Old shingle roof can be left in place provided that there are not more than two previous layers of shingles and that the existing shingles are not water saturated". That is the County's own statement. This record does not restate the Virginia code's recover limit: a reroof of an existing house is addressed by the Virginia Existing Building Code, whose section 602.3.2.1 sends "recovering or replacing an existing roof covering" to Chapter 15 of the Virginia Construction Code, and by the reroofing section of the Virginia Residential Code. Stafford County Code Sec. 6-16 adds no roofing provision to the Virginia code.
Deck & sheathing requirements
Virginia's amendments to the International Residential Code in the 2021 Uniform Statewide Building Code (13VAC5-63-210) do not amend the IRC's roof sheathing provisions (R803), and Stafford County Code Sec. 6-16 adopts the USBC with insertions only at sections 1807.2.1, 1807.2.2, P-303.3 and P-308.3, adding no roof sheathing provision of its own. Replacing more than 256 square feet of roof decking on a house or townhouse, or any decking that was required to be fire-retardant-treated or protected to form a fire-rated wall termination, needs a permit (Virginia Construction Code 108.2, item 14.6); the County's fee schedule prices residential "Roof Replacement (structural not shingles)" plan review and inspection at "$0.04/sq. ft.; $50 minimum" each.
Sales & use tax
5.3% general sales and use tax in Stafford County (Virginia Tax, "Sales and Use Tax Rates by Locality" workbook, "Jan 2026 - Present" block, "From January 1, 2026 to Present": Stafford, locality code 51179, General Sales 5.3%). That is the 4.3% state rate (Code of Virginia 58.1-603) and the 1% local option tax (58.1-605); Stafford County carries no additional regional tax in that workbook. A roofing contractor is treated as the consumer of the materials: Virginia's regulation says "the law treats every contractor as the user or consumer of all tangible personal property furnished to the contractor or by the contractor in connection with real property construction, reconstruction, installation, repair, and similar contracts" and that a contractor "does not pass the sales or use tax on to anyone else as a tax" (23VAC10-210-410). So the rate is paid on materials when bought, repair and replacement alike; the roofer's labor on the house is not taxed to the homeowner.
