- state_level: New Jersey requires home improvement contractors to register with the Division of Consumer Affairs. The Contractors' Registration Act as enacted in 2004 (P.L.2004, c.16), C.56:8-138(a), reads: "No person shall offer to perform, or engage, or attempt to engage in the business of making or selling home improvements unless registered with the Division of Consumer Affairs in accordance with the provisions of this act." The Uniform Construction Code's permit rule, N.J.A.C. 5:23-2.15(b)9, reads: "If work involves a home improvement performed by a contractor, such contractor shall be registered pursuant to N.J.S.A. 56:8-136 et seq. The registration number of the contractor shall appear on the permit application."
- city_level: South River's construction code chapter (Chapter 129) sets up no contractor licence or registration. The Building Department FAQs say that if work "is from a regulated trade, documentation of a license or registration from the appropriate licensing board will be required," list "Home Improvement Contractors" among the regulated trades, and add "General contractors and builders are required to have a Home Improvement Contractors Registration." Separately, the borough's Licensed Trades and Occupations chapter makes it unlawful "to conduct, engage in or carry on any business, trade, occupation or activity within the Borough of South River" without a licence from the Borough Clerk (South River Code 209-1); that is a general business licence, and the chapter "shall not apply to any business or occupation licensed under those various laws of this state which prohibit licensing by municipalities" (209-19). The record does not decide whether that exception reaches a home improvement contractor.
