The building permitting authority for the City of Marion, Indiana, the seat of Grant County, working out of 301 South Branson Street. This is Marion in Grant County, not Marion County, which is Indianapolis. The City's department covers property inside the city limits only; the Grant County Area Plan Department is a separate office on a separate phone line, 765-668-4765, and the City's own permit application asks first whether the job is inside the city limits and sends anything outside them to the appropriate office. Three things a roofer should know before bidding here. Every contractor must be registered with the City, with insurance on file, before starting any job. The roof gets its own inspection after tear-off, and the City states that ice and water shield is required and is checked at that inspection, although the state's table for Grant County does not list it as mandatory. And the City's two permit documents draw the reroof line in different places.

  • license: A CITY REGISTRATION WITH INSURANCE ON FILE, RENEWED EVERY YEAR. The City's Contractor Registration page opens: "All contractors doing work in the city limits must be registered to do so." The requirement is Chapter 113 of the Marion Code, from Ordinance 9-2005, which the City publishes as a 2017 printout of the chapter. Section 113.01(A) reads: "Any person, partnership or corporation that enters into any contract (verbal or written) with another person, partnership or corporation to engage in any type of construction activity, including demolition work, in or upon real estate located within the city must be registered under this chapter." Subcontractors are included, and section 113.01(E) excludes only owners and tenants: "Property owners and tenants working on their own property are excluded from registration." WHAT IT TAKES. Section 113.04 requires bodily injury, property damage and worker's compensation insurance, the liability policy in minimum amounts of "$500,000.00 for any occurrence relative to which there is an injury or death to one or more persons" and "$100,000.00 for any occurrence relative to which there is damage to property". The Building Commissioner's cover letter on the current application asks for a certificate of insurance naming the City of Marion Building Department as certificate holder, proof of worker's compensation, and, for a sole proprietor or partnership, a Worker's Compensation Clearance Certificate from the State of Indiana Worker's Compensation Board. Section 113.05(C): "The contractor registration shall be for a one year period beginning on the date of issuance." FEES. Roofing has no category of its own; the published fee schedule lists General Contractor and Non-Categorized at $200.00 unrestricted or $150.00 residential, with HVAC, electrical and plumbing at $125.00 and $100.00, and $50.00 for a sole proprietor or partnership. THE PENALTY. The permit application lists "$250.00 Contractor Registration not completed prior to starting work on any project (General or Subcontractors)", and section 113.99 provides that "whosoever violates any provision of this chapter shall be subject to a fine of not less than $100 and not more than $1,000. Each day may be considered a separate violation." Section 113.08(A) lets the Building Inspector stop work being done by an unlisted contractor.
Permit process note
WHERE. The Building Department is at 301 South Branson St., Marion, IN 46952, on 765-662-9931, toll free 833-662-9935, with Justin Dickerson as Building Commissioner, Spencer Petty as Permit Compliance Officer and McKenna Cardona as Administrative Assistant. The Grant County Area Plan Department is a different office; the City's application asks first whether the job is inside the city limits. ORDER OF OPERATIONS. Register as a contractor first, since the City charges $250.00 for starting any project before registration is completed, then file the Residential Building Permit Application, ticking the ROOF box and stating the approximate cost of the job. The contractor section of the application reads: "ALL CONTRACTORS ARE REQUIRED TO BE REGISTERED PRIOR TO STARTING WORK." MONEY. On the residential fee schedule, read from the rendered page, the Int./Ext. Cosmetic Remodel line, which names roof, is $60.00. The application states that fines are separate from and in addition to the normal registration and permitting fees, and that all fines or fees must be paid in full before any permit will be issued. INSPECTIONS. A roof inspection after tear-off and a final, booked with twenty-four hours' notice, with someone on site. A dumpster placed in the City right of way, alley or sidewalk needs a separate Right-of-Way permit from the Engineering Department.

THE STATE'S RESIDENTIAL CODE, AND THE CITY HAS PUBLISHED NO STATEMENT OF WHICH EDITION IT ENFORCES. Indiana writes its residential code as a state rule: 675 IAC 14-4.4, the 2020 Indiana Residential Code, which adopts and amends the first printing of the 2018 International Residential Code. The rule's own scope clause, section R101 as rewritten by 675 IAC 14-4.4-2, reads: "The provisions of this code apply to the construction, prefabrication, alteration, addition, and remodel of detached one or two family dwellings and one family townhouses not more than 3 stories in height and their accessory structures." The Indiana State Building Commissioner's memo of February 25, 2020 puts the reach of it plainly: "The 2020 Indiana Residential Code is in full force and effect statewide." WHAT IS NOT ESTABLISHED FOR MARION. The City's Code of Ordinances is published on codelibrary.amlegal.com, and the City's own building chapter, including any section adopting the state rules by reference, was not opened for this record. None of the City's permit documents names a code edition; the inspection sheet says only that work "MUST BE PER CURRENT BUILDING CODES". This record therefore reports the state edition and makes no claim about what the City's codified chapter says.
Drip edge
Required — REQUIRED BY THE STATE'S RESIDENTIAL CODE, WITH NO CITY RULE FOUND EITHER WAY. The Indiana State Building Commissioner's memo on ice/water shield and drip edge reproduces section R905.2.8.5 of the 2020 Indiana Residential Code as adopted, and its first sentence reads: "A drip edge shall be provided at eaves and rake edges of shingle roofs." The rest of the section, reproduced in the memo, sets the overlap, extension and fastening of the drip edge and the order of underlayment at eaves and rakes. The state rule, 675 IAC 14-4.4, amends the asphalt-shingle flashing section above it only by deleting the word "approved", and makes no change to the drip-edge section. The City's permit documents say nothing about drip edge, and the City's codified building chapter was not read for this record. The roof is inspected after tear-off and again at final, so expect the drip edge to be seen. About drip edge
Ice & water shield
Required — THE CITY SAYS REQUIRED; THE STATE'S TABLE FOR GRANT COUNTY SAYS NO. BOTH ARE REPORTED. The Building Department's own sheet of required inspections, which is also printed inside its residential permit application, reads: "ROOF: AFTER TEAR OFF AND A FINAL. ICE AND WATER SHIELD IS REQUIRED AND MUST BE INSPECTED." So on a Marion job the membrane is checked at the tear-off inspection. The state side reads differently. The Indiana Residential Code's Table R301.2(1), as amended by 675 IAC 14-4.4-5, runs county by county, and the Grant County row prints No in the ice shield underlayment column. The State Building Commissioner's memo explains what that No means: "Note that the table lists specific Indiana counties in which the use of ice/water shield is required", and elsewhere the membrane is required "only when the roofing manufacturer's written installation instructions require it". This record publishes the City's stated requirement because it is the standard applied at the City's own roof inspection, and it does not decide whether the City could hold a roofer to it where the manufacturer's instructions do not call for it. Budget the membrane at the eaves on every Marion reroof. About ice & water barrier
Mid-roof inspection
Required — YES, A TEAR-OFF INSPECTION, AND IT IS WRITTEN DOWN. The Building Department's sheet of required inspections for all residential and commercial construction lists, as item 4, "ROOF: AFTER TEAR OFF AND A FINAL. ICE AND WATER SHIELD IS REQUIRED AND MUST BE INSPECTED." So the deck is seen with the old covering off, before the new one goes on, and the job is seen again at final. HOW TO BOOK IT. Call 765-662-9931 between 8:00 A.M. and 4:00 P.M., Monday to Friday, with the permit number and the job address; "TWENTY-FOUR (24) HOUR NOTICE IS REQUIRED WHEN REQUESTING AN INSPECTION." The contractor or the owner must be on site or the inspection will not be done. The sheet warns there "MAY BE A SIXTY-DOLLAR ($60.00) FEE FOR MISSED SCHEDULED INSPECTIONS", and the permit application adds that "IF REQUIRED INSPECTIONS ARE NOT PERFORMED, A $200.00 FINE WILL BE IMPOSED". Plan the tear-off so the deck can stay open, or dried in, until the inspector has been.
Repair permit threshold
THE CITY'S TWO PERMIT DOCUMENTS DRAW THE LINE IN DIFFERENT PLACES, AND BOTH ARE REPORTED HERE RATHER THAN ONE BEING CHOSEN. The Building Department's checklist, headed "DO YOU NEED A BUILDING PERMIT?", lists as its third item "All new roofing or roof requiring repairs." with no dollar or size floor attached. A separate item on the same sheet sets a cost test for other work: "Any cosmetic remodel (drywall, flooring, siding, etc.) when the cost of the project exceeds $1,500.00." The City's Residential Permits web page puts roofing on the other side of that line: "If the cost of the job exceeds $1,500.00 for interior or exterior cosmetic remodeling (siding, paint, roof, flooring dry wall, etc.), a residential permit is required." So on the checklist every new roof and every roof repair needs a permit, while on the web page roof work under $1,500.00 appears not to. The fee schedule prices roof work under a dedicated line, "Int./Ext. Cosmetic Remodel", described as "(Siding, roof, paint, flooring, drywall, etc.)", and the permit application carries a ROOF box of its own. The City's codified permit chapter, published on codelibrary.amlegal.com, was not opened for this record, so no enacted threshold is reported. A full reroof on a house clears $1,500.00 in any case, so the two documents agree on the ordinary replacement job; they part only on small repairs. THE COST OF GUESSING WRONG. The permit application lists, as of July 1st, 2024, "$200.00 Starting work without a permit" and "$150.00 Stop Work Order issued", each separate from and in addition to the normal permit fee. For a small repair, ask the Building Department on 765-662-9931 before starting.
Wind design criteria
THE FIGURES ARE THE STATE'S COUNTY-INDEXED TABLE, NOT A MARION ENACTMENT. Table R301.2(1) of the Indiana Residential Code, as amended by 675 IAC 14-4.4-5, gives the Grant County row as wind speed 115 mph, seismic design category A, ground snow load 20 psf, frost depth 30 inches, winter design temperature 2 degrees Fahrenheit, decay slight to moderate, termite moderate to heavy, weathering severe, ice shield underlayment required No, air freezing index 1500 or less, and mean annual temperature 50.3 degrees. The City's permit documents publish no design criteria of their own. Note that the No in the ice shield column is not the answer on a Marion job: the City's inspection sheet states that ice and water shield is required and inspected, as this record's ice and water shield entry explains.
Sales & use tax
7.00% in Marion, the Indiana state sales and use tax rate. The Department of Revenue's county tax information page states: "The sales tax for the entire State of Indiana is 7%." WHO PAYS IT ON A ROOF DEPENDS ON THE CONTRACT. The Department's Sales Tax Information Bulletin #60 explains that a contractor on a time and material contract "is a retail merchant that is selling the construction material that it incorporates into real property" and collects sales tax on the material portion, while a contractor on any other type of contract, such as a lump sum, "must pay sales or use tax on their construction material" and does not collect it from the customer. Read the bulletin, or ask an accountant, before pricing a job either way.
