It amends the Las Animas County Building Code to adopt the 2018 International Building Code with Appendices C and J, the 2018 International Residential Code with Appendices E, F, G, M, Q, R, S and U but excluding the sprinkler requirements at R313 and P2904, the 2018 International Energy Conservation Code, the 2018 International Existing Building Code, the 2018 International Mechanical Code and the 1997 Uniform Code for the Abatement of Dangerous Buildings, replacing the County's 2009-edition adoption of March 5, 2013, throughout the entire unincorporated area of the County. Its own amendments reaffirm the permit-expiration rule of August 7, 2012 and conform the construction cost schedule, the fee schedules including Appendix L of the Residential Code and Appendix B of the Mechanical Code, and the Board of Appeals provisions at Appendix B of the Building Code to Resolutions 12-034, 12-035 and 12-052. As to the statewide floor, the Colorado Wildfire Resiliency Code, 8 CCR 1507-39, took effect July 1, 2026 in areas designated wildland-urban interface under that code and requires a Class A roof covering tested to ASTM E108 or UL 790 where 25 percent or more of the roof surface is replaced, at its Sections 101.6 and 403.2, which is a fire classification independent of impact rating and sets no impact-resistance requirement. By Resolution No. 26-017, adopted March 31, 2026, the Board of County Commissioners found that the Code may constitute an unfunded state mandate within the meaning of C.R.S. 29-1-304.5 and directed County staff to refrain from implementing or enforcing new Code-specific regulatory requirements unless and until adequate funding is identified or the Board takes further formal action, while stating that the resolution is not a final determination regarding adoption or non-adoption of the Code.
