The 2021 International Residential Code, as adopted by the State in the Maine Uniform Building and Energy Code (MUBEC). The State's residential rule, 08-003 C.M.R. chapter 6 (formerly 16-642 C.M.R. chapter 5), adopts "Chapters 1 - 11", "Chapter 15", "Chapter 44" and six appendices of the 2021 International Residential Code, effective March 4, 2025 (Secretary of State filing 2025-046). None of the State's changes touches Chapter 8, Roof-Ceiling Construction, or Chapter 9, Roof Assemblies, so those apply as the International Code Council publishes them. Work on existing buildings also falls under the State's adoption of the 2021 International Existing Building Code (08-003 C.M.R. chapter 5), which makes no change to its reroofing section. The code is uniform statewide: "The MUBEC applies to all buildings constructed or renovated in Maine regardless of municipal population" (08-003 C.M.R. chapter 2, section 4(1)). "The Maine Uniform Building and Energy Code must be enforced in a municipality that has more than 4,000 residents" (10 M.R.S. 9724(1)), and a smaller municipality "is not required to enforce, but may not adopt or enforce a building code other than" the MUBEC (10 M.R.S. 9724(1-A)). A municipality may not write its own building rules: "any ordinance regarding a building code of any political subdivision of the State that is inconsistent with the Maine Uniform Building and Energy Code is void" (10 M.R.S. 9724(3)). It may adopt an ordinance "that sets forth provisions for local enforcement of building codes" (10 M.R.S. 9724(5)), which the State's rule says "may include items such as, permits, fees, boards of appeals and violations" (08-003 C.M.R. chapter 2, section 4(4)). The State's version of the residential code accordingly requires a permit only "where required by municipal ordinance" (Section R105.1) and lets a municipality exempt more work from permits (Section R105.2), so whether a reroof needs a permit is set by each municipality. The code does not apply to "Log homes or manufactured housing" or to "Post and beam or timber frame construction" (10 M.R.S. 9724(5)(A)). Drip edge
Required — Required at eaves and rake edges of shingle roofs. Maine adopts the 2021 International Residential Code without changing its drip edge rule, Section R905.2.8.5: "A drip edge shall be provided at eaves and rake edges of shingle roofs." Segments overlap by at least 2 inches, the drip edge extends at least 1/4 inch below the roof sheathing and at least 2 inches back onto the deck, it is fastened at no more than 12 inches on center, and "Underlayment shall be installed over the drip edge along eaves and under the drip edge along rake edges." Roof layer limit / recover
Two layers at most. Maine adopts the 2021 International Residential Code without changing its reroofing section, R908 (08-003 C.M.R. chapter 6; the State's list of changes names no Chapter 9 section). Section R908.3.1.1 says "A roof recover shall not be permitted where any of the following conditions occur," and the third condition is "Where the existing roof has two or more applications of any type of roof covering." So one existing layer may be covered once, and a roof that already has two layers is torn off to the deck: "Roof replacement shall include the removal of existing layers of roof coverings down to the roof deck" (R908.3). The same section also bars a recover "Where the existing roof or roof covering is water soaked or has deteriorated to the point that the existing roof or roof covering is not adequate as a base for additional roofing" and "Where the existing roof covering is slate, clay, cement or asbestos-cement tile." The existing-building code the State also adopts, the 2021 International Existing Building Code (08-003 C.M.R. chapter 5), carries the same two-application condition in Section 705.2.1.1. A municipal building-code ordinance inconsistent with the State code is void (10 M.R.S. 9724(3)). Everything above is Maine state law, the same in every municipality. Deck & sheathing requirements
State rules from the base code. Maine adopts the 2021 International Residential Code without changing Section R803, Roof Sheathing (08-003 C.M.R. chapter 6; the State's only Chapter 8 change adds sawn-lumber grade-mark exceptions to R802.1.1 for permit-exempt and small accessory structures). Lumber roof sheathing follows Table R803.1: over rafters or beams 24 inches apart it must be at least 5/8 inch net thick. Wood structural panels "shall be identified for grade, bond classification and performance category by a grade mark or certificate of inspection issued by an approved agency," and their spans "shall not exceed the values set forth in Table R503.2.1.1(1) or APA E30." For shingles, "Asphalt shingles shall be fastened to solidly sheathed decks" (R905.2.1), and on any reroof "The structural roof components shall be capable of supporting the roof covering system and the material and equipment loads that will be encountered during installation of the roof covering system" (R908.2). Sales & use tax
5.5% Maine sales and use tax, set by the State and the same in every municipality: "the rate of tax is 5.5% on the value of all tangible personal property and taxable services" (36 M.R.S. 1811(1)(D)), and Maine Revenue Services' rate table lists the general sales rate and use tax at 5.5% with no local rate. Who pays it on a reroof depends on how the roofer bills. Maine Revenue Services treats roofing contractors like other contractors: on a construction contract, "a contract for repair, alteration, improvement, remodeling or construction of real property," "The contractor, as the last user of the materials as tangible personal property, pays a sales or use tax when purchasing the materials," and in its example "does not add sales tax to the lump-sum charge to the customer." A contractor that bills "on a time-and-materials basis, charging sales tax on all materials sold" and is registered as a retailer may instead buy materials tax-free for resale and charge the customer the tax on the materials (Instructional Bulletin No. 4). Labor is not taxed when billed separately: the taxable sale price does not include "The price received for labor or services used in installing or applying or repairing the property sold or fabricated, if separately charged or stated" (36 M.R.S. 1752(14)(B)(4)).
