The building permitting authority for the City of American Falls, Idaho, the seat of Power County on the Snake River south-west of Pocatello. The Building Department is combined with Planning and Zoning under one office and one Building Official, and it issues permits, reviews plans and performs inspections for property inside the City limits; a property inside the City's impact area but outside the City limits is instead routed to the Power County Building Administrator's office. The City's own building page states, without citing an ordinance number, that it "Adopts the International Code (2018)" and "Adopts the Uniform Fire Code (2018)," and directs a reader to a "Codes" link on a vendor code-hosting site. That vendor host could not be reached this session -- it has no published DNS address at all -- and the City's own general Code of Ordinances, read in full on its current Municode codification (all ten titles and every chapter within them), contains no title or chapter adopting a building code; whatever ordinance the City relies on for its building-code adoption was evidently never folded into that general recodification. The roofing answers in this record that depend on the exact edition and any local amendment of the residential code are therefore held rather than guessed; what this record does establish rests on the City's own permit application and fee schedule, on Idaho's statewide contractor-registration and sales-tax statutes read directly from the Legislature's site, and on the Idaho Building Code Board's own current administrative rule.

  • state_level: STATEWIDE, AND INDEPENDENT OF WHATEVER THIS CITY REQUIRES. Idaho Code 54-5204(1), in the Idaho Contractor Registration Act (Title 54, Chapter 52): "On and after January 1, 2006, it shall be unlawful for any person to engage in the business of, or hold himself out as, a contractor within this state without being registered as required in this chapter." A roofer sits inside the definitions rather than at their edge: "Construction" means "the performance of building, altering, repairing, adding to, subtracting from, improving, reconstructing, moving, excavating, wrecking or demolishing any building ... or other structure, project, development or improvement to real property, or to do any part thereof" (54-5203(2)), and "Contractor" means any person who "undertakes, offers to undertake, purports to have the capacity to undertake, or submits a bid to, or does himself or by or through others, perform construction" (54-5203(3)(a)). It is a registration administered by the Idaho Contractors Board within the Division of Occupational and Professional Licenses, not a competency licence with an exam. THRESHOLD. 54-5205(2)(f) exempts "one (1) undertaking or project considered casual, minor, or inconsequential, whether by one (1) or more contracts, the aggregate contract price of which, for labor and materials and all other items, is less than two thousand dollars ($2,000)" -- a per-project figure covering labour and materials together -- and the same paragraph voids the exemption where the job is split into contracts of less than two thousand dollars to evade the chapter. A residential reroof is rarely under $2,000.

American Falls' own building-code ordinance, and any contractor-registration or licensing provision it might carry, could not be located or read this session: the City's own "Codes" link (sterlingcodifiers.com) has no published DNS address, and the City's general Code of Ordinances, read in full on Municode, contains no building-code chapter and no contractor-licensing provision outside the generic business-licence mechanics of Title 3, Chapter 1 (which names no building trade and no roofing category). That is evidence, not a sourced local negative, so this record does not assert American Falls has no local contractor-licensing requirement on top of the mandatory state registration; it reports only that none was found in what could be opened. Confirm directly with the Building Department (208-226-2569). The state registration above applies in American Falls regardless of the answer.
Permit process note
WHERE A PROJECT IS ROUTED DEPENDS ON WHETHER THE PARCEL IS INSIDE THE CITY LIMITS OR ONLY INSIDE THE CITY'S IMPACT AREA. The City's own "How to get a permit" guide states: "The first step in the permit process is addressing. If the property is within the City's impact area your plans will be routed to the Power County Building Administrator's office along with the permit fee made payable to Power County. The permit fee is then routed back to the City. If your property is in the City limits your plans will be addressed in our office ... The City Building Department will only issue building permits on property located in the City." A roofer working just outside the City limits should confirm with Power County directly which office actually issues the permit for that address. WHAT THE CITY DOES NOT HANDLE. "The Idaho Division of Building Safety does plumbing, electrical, HVAC" -- the guide gives separate numbers, Electrical Inspector 208-237-2460 and Plumbing & HVAC 208-238-3359, and states a roofer or general contractor must contact the state Division directly for those trades rather than the City. INSPECTIONS. The guide states plainly: "do not pour concrete or cover anything up before having it inspected by an inspector either building, plumbing or electrical," and that a final inspection, once building, plumbing and electrical work all pass, results in a Certificate of Compliance. THE CITY'S OWN WEB PAGE NAMES TWO CODES BY EDITION YEAR BUT CITES NO ORDINANCE, AND ITS OWN "CODES" LINK IS DEAD. The American Falls Building Department page states, under a "City of American Falls Building Code Requirements" heading: "Building Permit (City)", "Adopts the International Code (2018)", "Adopts the Uniform Fire Code (2018)", "Plumbing Permit & HVAC (state)", "Electrical Permit (state)." That page supplies a "Codes" link to a vendor code-hosting site (sterlingcodifiers.com, book_id 458), but that host has no A record at all -- confirmed against Google's public DNS resolver directly, not merely against this session's own network, which returned NOERROR with an empty answer for the bare domain and NXDOMAIN for the www subdomain. No archived copy of that book could be located either. THE CITY'S GENERAL CODE OF ORDINANCES HAS NO BUILDING-CODE CHAPTER AT ALL. The City's own Administration page links its current codification on Municode (Code of Ordinances, recodified through Ordinance No. 667, adopted November 6, 2024). That codification was read in full this session, title by title and chapter by chapter: Title 1 Administration, Title 2 Commissions and Boards, Title 3 Business Regulations (its Chapter 1, Licenses and Permits, covers only general business-licence mechanics), Title 4 Police Regulations, Title 5 Fire Regulations (Fire Department, Fire Prevention Code, Fireworks, Explosives), Title 6 Public Services (water, wastewater, refuse), Title 7 Public Ways and Property, Title 8 Traffic, Title 9 Development Code (zoning and subdivision regulation, not construction standards), and Title 10 Revenue and Finance. None of the ten titles adopts the International Residential, Building, Existing Building or Energy Conservation Codes, or any construction code at all. The Code's own master ordinance-to-section index (the "Code Comparative Table - Legislation," every ordinance the City has ever enacted and where it landed) was also searched directly and returns zero occurrences of "build," "IRC," "International Residential," "International Building," "construction code" or "ICC." Whatever instrument the City relies on to adopt its building code was therefore never folded into this general recodification, and no standalone ordinance PDF for it is posted anywhere else on the City's own site (its "/ordinances/" and "/city-code/" paths both 404). THE STATE FLOOR THIS CITY OPERATES UNDER, AS CONTEXT. Idaho Code 39-4116(2) requires a local government that issues building permits and enforces the code to adopt the state's residential code parts I, II, III and IX by ordinance, and bars adopting provisions of a later IRC edition than the one the Idaho Building Code Board has adopted. The Board's own current rule, IDAPA 24.39.30.600.03, adopts the "International Residential Code, 2018 Edition ... Parts I, II, III, and IX of the 2018 Edition for one (1)- and two (2)- family dwellings," together with a seventeen-item amendment list (items a. through q.), effective July 1, 2024, plus the 2018 International Existing Building Code and the 2018 International Energy Conservation Code (commercial and residential provisions). That is the same "2018" edition year the City's own web page names, and it is the mandatory statewide floor and ceiling Idaho law imposes on any city in American Falls' position -- but WHICH of the City's own ordinance provisions actually govern here, and whether the City has adopted any local amendment of its own on top of that state rule, is not established by anything this session could read. This record does not assume the City has made no local amendment; it reports that no City instrument stating one, or confirming the absence of one, could be opened.
Repair permit threshold
NO DOLLAR OR SQUARE-FOOTAGE THRESHOLD IS PUBLISHED ANYWHERE THIS RECORD COULD READ, AND THE FEE SCHEDULE REACHES THE FIRST DOLLAR OF VALUE. The City's Consolidated Building-Development Permit Application lists "REPAIR" as one of eight classes of work the application covers (alongside grading, new construction, addition, alteration, demolition, moving a structure and signs), with no roofing-specific line item and no stated exemption. The City's own Building Fees page sets a permit fee starting at the very first valuation bracket, "$1.00 to $500.00 -- $23.50," with no minimum valuation below which a permit or fee is waived, and no separate exempt-work list of any kind printed on that page. WHAT IS NOT ESTABLISHED. Idaho's model residential code exempts certain minor work from a permit under its own Section R105.2, and IDAPA 24.39.30.600.03 makes two narrow amendments to that list (a dimension change to an existing item and a new flagpole exemption), neither touching roofing -- but the text of the base exemption list itself sits behind the code publisher's paywall and was not opened this session, and the City's own building-code ordinance, whatever it is, could not be located or read (see adopted_code). This record therefore does not assert there is no square-footage or dollar exemption for a small roof repair in American Falls; it reports only that none is printed on any City document this session could open. Confirm directly with the Building Department (208-226-2569) before assuming a small repair needs no permit. ONE DEFINITION THAT LOOKS LIKE A THRESHOLD AND IS NOT ONE. IDAPA 24.39.30.002.02 defines a "Minor Alteration," including "roof repairs involving installation of less than one hundred (100) square feet of new roof covering," but the rule states in the same sentence that this definition applies "for the purpose of administering annual permits" -- a Division of Building Safety mechanism (IDAPA 24.39.30.500.01) for state agencies and school districts with their own in-house trades staff, not a municipal permit-exemption threshold for a City resident's reroof. This record does not use that figure as American Falls' repair threshold.
Sales & use tax
6.0% -- the Idaho state rate, with no local add-on. Idaho Code 63-3619 imposes the state sales tax "at the rate of six percent (6%)." Idaho has only two kinds of local sales tax, and neither reaches American Falls. The first is the resort-city local-option tax: the Idaho State Tax Commission's own current "City Sales Taxes" page names every city that levies one -- Bellevue, Bonners Ferry, Cascade, Crouch, Donnelly, Driggs, Hailey, Harrison, Irwin, Kellogg, Ketchum, Lava Hot Springs, Mackay, McCall, Ponderay, Riggins, Salmon, Sandpoint, Stanley, Sun Valley, Swan Valley, Tetonia and Victor -- and neither American Falls nor any other Power County city is on it. The second is an auditorium- district tax; the Commission's own Auditorium District Taxes page lists the districts it administers (Greater Boise, Idaho Falls, Mountain Community Center, Nampa, Pocatello-Chubbuck) and states plainly that such a district "can charge a local sales tax only for short-term lodging (30 days or less)" -- it never touches a roofing job in any event, and American Falls and Power County do not appear on that page either. Idaho counties levy no sales tax of their own, so being in Power County adds nothing.
