The 2021 International Residential Code, as adopted by the State in the Pennsylvania Uniform Construction Code (UCC). 34 Pa. Code 403.21(a)(7) adopts "The 'International Residential Code of 2021,' except that:" followed by the State's list of exclusions and modifications, effective January 1, 2026 (55 Pa.B. 7701). None of the State's changes touches Chapter 9, Roof Assemblies, or Section R803, Roof Sheathing, so those apply as the International Code Council publishes them. Work on existing buildings is also pointed to the State's existing-building code: "The repair, alteration, change of occupancy, addition and relocation of existing buildings must comply with Chapter 34 of the 'International Building Code of 2021' or with the 'International Existing Building Code of 2021'" (34 Pa. Code 403.21(f)). The UCC is the minimum everywhere in the state: "no municipality may propose or enact any ordinance which is less than the minimum requirement of the Uniform Construction Code" (Pennsylvania Construction Code Act, Act 45 of 1999, section 503(b)). The Act also lists work it "shall not apply to", including "Alterations to residential buildings which do not make structural changes or changes to means of egress" or to "Repairs to residential buildings," in each case "except as might be required by ordinances" kept in force under section 303(b)(1) or adopted under section 503 (Act 45 section 104(b)(5) and (6); 34 Pa. Code 403.1(b)(8) and (9)). The Act defines a repair as "The reconstruction or renewal of any part of an existing building for the purpose of its maintenance." So whether the code's roofing rules reach a given house reroof depends on the municipality's own ordinances. Everything above is Pennsylvania state law, the same in every municipality. Locally, York Township administers the code itself: Section 111-1 of the Township Code says "York Township hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act," and the Township's Building and Zoning page says "Codes Enforcement Officers are employed by York Township to enforce building and property maintenance codes." Chapter 111 of the Township Code, Construction Code, Uniform (Sections 111-1 to 111-8, Ord. No. 2004-7, with Sections 111-7 and 111-8 added by Ord. No. 2004-17), was read in full in the Code the Township publishes as updated to June 2020; it adopts the Uniform Construction Code "as amended from time to time" and changes nothing in the code's roofing provisions. The ordinances the Township has posted since that update, numbered 2020-05 through 2023-05 and 2024-04, deal with streets, budgets, taxes, zoning, policing, sewers and stormwater, and none amends Chapter 111; the Township's website does not post every ordinance adopted after 2023. Section 111-7 exempts named repairs and alterations, roof material replacement among them, quoted in the permit entries of this record. Chapter 98 of the Township Code, Building Construction, still adopts the "BOCA National Building Code, Thirteenth Edition, 1996" and, for one- and two-family dwellings, the "CABO One and Two Family Dwelling Code, 1995 Edition" (Ord. Nos. 96-5 and 96-6), and Section 111-5 keeps in force building code ordinances adopted on or before July 1, 1999, "and which equal or exceed the requirements of the Code"; this record has not read the 1995 and 1996 codes' text, including their permit and roofing provisions.
Permit process
Section 111-7 of the Township Code (added December 14, 2004, by Ord. No. 2004-17) says "All alterations to residential buildings which do not make structural changes or changes to means of egress and repairs to residential buildings shall be subject to compliance with the Uniform Construction Code" and then "provided, however, that the following repairs and alterations shall be exempt from such compliance," listing as item I "Replacement of any roof material so long as the existing roof material is removed prior to installation of new." The condition is about the work: the existing roof material is removed first. A recover laid over existing roofing does not meet it. Item U of the same section says "An ordinary repair does not require a permit" and lists as not ordinary repairs cutting away a wall, "The removal or cutting of any structural beam or load-bearing support," changes to means of egress, and piping, electric or mechanical work. The section states no size threshold. Read October 6, 2026, the Township's Building and Zoning page says "Contact the Township for information regarding the need for a building permit for proposed work" and "Building permits must be obtained before you start the work, and the permit must be displayed on the worksite!"; its residential permit list (deck, fence, finished basement, patio, addition, shed, pool and detached garage) and its residential permit application (revised 4-2024) name no roof work. The Township's 2026 fee schedule (Resolution 2026-09, adopted May 12, 2026) has no roofing line; it charges "Building Permit (Cost of Construction)" at $4.00 per thousand. Under state law, Act 45 says the Act "shall not apply to" "Alterations to residential buildings which do not make structural changes or changes to means of egress, except as might be required by ordinances in effect pursuant to section 303(b)(1) or adopted pursuant to section 503" or to "Repairs to residential buildings, except as might be required by ordinances in effect pursuant to section 303(b)(1) or adopted pursuant to section 503" (section 104(b)(5) and (6)), and 34 Pa. Code 403.62(c) says "A permit is not required for the exceptions listed in § 403.1(b) (relating to scope) and the following, if the work does not violate a law or ordinance". The Department of Labor and Industry's register of municipal code change ordinances lists a York Township ordinance that "Requires a UCC permit for residential alterations and repairs and outlines numerous exceptions," with an approval letter mailed November 24, 2004, and enactment on December 14, 2005. The Township's Code was read as published updated to June 2020. The ordinances the Township has posted since that update, numbered 2020-05 through 2023-05 and 2024-04, deal with streets, budgets, taxes, zoning, policing, sewers and stormwater, and none amends Chapter 111; the Township's website does not post every ordinance adopted after 2023. A residential permit application asks for the contractor's PA HIC registration number and the total cost of construction; the page says "Building Inspections can be scheduled for Monday through Friday between 7:30 a.m. and 2:15 p.m." with 24 hours' notice.
