The Minnesota State Building Code. Its residential part is Minnesota Rules chapter 1309, under which "The 2018 edition of the International Residential Code" is "incorporated by reference and made part of the Minnesota State Building Code except as qualified by the applicable provisions in Minnesota Rules, chapter 1300, and as amended in this chapter" (Minnesota Rules part 1309.0010). State law makes it the code everywhere in Minnesota: "The State Building Code is the standard that applies statewide for the construction, reconstruction, alteration, repair, and use of buildings and other structures of the type governed by the code," and "The State Building Code supersedes the building code of any municipality" (Minn. Stat. 326B.121, subd. 1). A municipality "must not by ordinance, or through development agreement, require building code provisions regulating components or systems of any structure that are different from any provision of the State Building Code" (Minn. Stat. 326B.121, subd. 2(c)); the one exception is a more restrictive ordinance that the state building official approves "where geological conditions warrant" it. A municipality whose ordinance adopted the code as of January 1, 2008 "must continue to administer and enforce the State Building Code within its jurisdiction" (subd. 2(a)). The State changes two parts of Chapter 9, Roof Assemblies: Minnesota Rules part 1309.0903 rewrites the flashing section, R903.2.1, and says "Kick-out flashings are not required when only re-roofing existing buildings and structures"; part 1309.0905 rewrites the shingle sheathing section and deletes the drip-edge section. Everything above is Minnesota state law, the same in every city. The City of St. Francis Building Department administers and enforces the State Building Code in St. Francis.
