Roofing permits & building code in Mount Vernon

Roofing permit and contractor-licensing rules in Mount Vernon are set locally by City of Mount Vernon - Department of Buildings. New York issues no state licence or registration for roofing or home improvement contractors, but its home improvement law requires every roofing contractor, including subcontractors and day labourers though not an owner working on their own home, to sign a written contract with the owner, forbids it to demand a deposit or to offer to pay the owner’s insurance deductible, and requires it to show proof of workers’ compensation and liability insurance, and that law does not excuse a contractor from any county or city law regulating home improvement contractors, so a local licence may also apply, while the Uniform Fire Prevention and Building Code, through the Residential Code of New York State, applies in every city, town and village outside New York City, is enforced by the city, town or village (or by the county or the Department of State where it has opted out), and may be made stricter locally only with the approval of the State Fire Prevention and Building Code Council — always confirm the current requirements with the authority before starting work.

Adopted building code
The 2025 Residential Code of New York State, part of the New York State Uniform Fire Prevention and Building Code (the Uniform Code), in effect since December 31, 2025. Under 19 NYCRR 1220.2(a), the "construction, alteration, movement, enlargement, replacement, repair" of detached one- and two-family dwellings and townhouses not more than three stories above grade plane "shall comply with the provisions and requirements of the 2025 RCNYS," the International Code Council publication of that name dated July 2025 (19 NYCRR 1219.2(a)(8)), which is built on the 2024 International Residential Code with New York's amendments. For an existing house the code adds: "Existing roof assemblies undergoing repair, where such work includes recovering or replacing an existing roof covering, shall comply with the applicable requirements of Section R908" (Appendix BO, Section BO104.8, which Section R101.2.1 adopts). The Uniform Code reaches every city, town and village outside New York City: "every local government shall administer and enforce the uniform fire prevention and building code" (Executive Law 381(2)), a local government being "a village, town (outside the area of any incorporated village) or city" (Executive Law 372(11)); cities of over one million people keep their own codes (Executive Law 383(1)(c)). A city may "enact or adopt local laws or ordinances imposing higher or more restrictive standards for construction" than the Uniform Code, but such a law takes "full force and effect upon an affirmative determination by the council," the State Fire Prevention and Building Code Council (Executive Law 379(1)), and otherwise "no municipality shall have the power to supersede, void, repeal or make more or less restrictive any provisions of this article or of rules or regulations made pursuant hereto" (Executive Law 379(3)). This record did not read the city's own local laws for any stricter standard the Council has approved. Everything above is New York state law, the same in every city outside New York City. In Mount Vernon the city's Department of Buildings enforces the code; the department's own page lists enforcing state and local building codes and reviewing permit applications for new construction, repairs and alterations among its functions.
