THE 2021 IRC, BY AN ORDINANCE THAT NAMES ONE- AND TWO-FAMILY DWELLINGS EXPRESSLY. Ordinance No. 3035 (City Commission, adopted following the July 26, 2022 agenda; the City's own Building Department page states "NEW BUILDING CODES (2021) TAKE EFFECT SEPTEMBER 23, 2022") amends Ordinance No. 2053 as codified in Chapter 6 of the Livingston Municipal Code, adopting by reference the 2021 International Building Code, 2021 International Residential Code, 2021 International Existing Building Code, 2021 International Energy Conservation Code, and 2021 International Swimming Pool and Spa Code. Its Section 6.9, Building code applicability, reads: "The 2021 International Building Code (IBC), the 2021 International Residential Code (IRC), the 2021 International Energy Conservation Code (IECC), the 2021 International Existing Building Code (IEBC) and the 2021 International Swimming Pool and Spa Code (ISPSC), are applicable to and shall be enforced upon all buildings within the building code enforcement area of the City of Livingston, including but not limited to residential buildings containing less than five dwelling units or their attached structures, any farm or ranch building, and any private garage or private storage structure used only for the owner's own use as provided by 50-60-102(l)(a) Montana Code Annotated." That is an express extension of the state building code to the exact class of structure Montana law otherwise excludes from it (MCA 50-60-102(1)(a)), naming the statute by number. The ordinance was read in full and amends nothing else touching roofing.
Registration details
  • state_level: Montana licenses construction contractors at the state level under MCA Title 37, chapter 45 (Construction Contractors), enacted by House Bill 239 (Ch. 644, L. 2025) and effective January 1, 2026; the 2025 Montana Code Annotated prints the former Title 39, chapter 9 (Contractor Registration) as renumbered and repealed. MCA 37-45-201(1) reads: "An individual or business entity may not engage in business as a construction contractor without a current license from the department." MCA 37-45-102(1) defines "construction contractor" as, "except as provided in 37-45-104, a person, firm, or corporation that: (a) in the pursuit of an independent business, offers to undertake, undertakes, or submits a bid to construct, alter, repair, add to, subtract from, improve, move, wreck, or demolish for another a building, highway, road, railroad, excavation, or other structure, project, development, or improvement attached to real estate, including the installation of carpeting or other floor covering, the erection of scaffolding or other structures or works, or the installation or repair of roofing or siding". MCA 37-45-104 opens "As related to construction contractors, this chapter does not apply:" and its list includes "(8) to work or operation on one undertaking or project considered of a casual, minor, or inconsequential nature, by one or more contracts, the aggregate contract price of which, for labor and materials and all other items, is less than $2,500 a job. The exemption prescribed in this subsection does not apply when the work or construction is only a part of a larger or major operation, whether undertaken by the same or a different construction contractor, or in which a division of the operation is made into contracts of amounts of less than $2,500 a job for the purpose of evasion of this chapter or otherwise." and "(24) to an independent contractor who has no employees. However, an independent contractor may voluntarily elect to register under this chapter." Sections 37-45-104 and 37-45-204 were redesignated from former MCA 39-9-211 and 39-9-304 by Sec. 20, Ch. 644, L. 2025, without amendment, and both still use the words "register" and "registered". The Montana Department of Labor and Industry's Construction Contractor License program page states: "All construction contractors with employees must register." The Department's Construction Contractor License FAQ (rev. 05/19/2026) answers "Who needs a Construction Contractor License?" with: "Anyone involved in the construction, alteration, repair, moving, or demolition of structures attached to real estate. This specifically targets contractors with employees, as well as corporations and manager-managed LLCs, regardless of employee count." This record decides neither whether a given reader is inside either exemption nor how a job is priced against the $2,500 line.
  • city_level: MCA 37-45-204 reads in full: "The provisions of this chapter relating to the registration or licensing of a person, firm, or corporation, including the requirement of a bond with the state of Montana named as obligee and the collection of a fee, are exclusive for registered construction contractors. A political subdivision of the state may not require or issue any registrations, licenses, or bonds for the same or a similar purpose. However, this section does not limit or abridge the authority of a local government to levy and collect a general and nondiscriminatory license fee levied upon all businesses. This section does not limit the authority of a local government with respect to contractors not required to be registered under this chapter."
