The 2025 Residential Code of New York State, part of the New York State Uniform Fire Prevention and Building Code (the Uniform Code), in effect since December 31, 2025. Under 19 NYCRR 1220.2(a), the "construction, alteration, movement, enlargement, replacement, repair" of detached one- and two-family dwellings and townhouses not more than three stories above grade plane "shall comply with the provisions and requirements of the 2025 RCNYS," the International Code Council publication of that name dated July 2025 (19 NYCRR 1219.2(a)(8)), which is built on the 2024 International Residential Code with New York's amendments. For an existing house the code adds: "Existing roof assemblies undergoing repair, where such work includes recovering or replacing an existing roof covering, shall comply with the applicable requirements of Section R908" (Appendix BO, Section BO104.8, which Section R101.2.1 adopts). The Uniform Code reaches every city, town and village outside New York City: "every local government shall administer and enforce the uniform fire prevention and building code" (Executive Law 381(2)), a local government being "a village, town (outside the area of any incorporated village) or city" (Executive Law 372(11)); cities of over one million people keep their own codes (Executive Law 383(1)(c)). A city may "enact or adopt local laws or ordinances imposing higher or more restrictive standards for construction" than the Uniform Code, but such a law takes "full force and effect upon an affirmative determination by the council," the State Fire Prevention and Building Code Council (Executive Law 379(1)), and otherwise "no municipality shall have the power to supersede, void, repeal or make more or less restrictive any provisions of this article or of rules or regulations made pursuant hereto" (Executive Law 379(3)).
